Isn't this case proof positive that the "Worst of the Worse" do not always receive the ultimate punishment. Peace to the victims of this evil man, I hope they found some consolation in being able to give their loved ones a proper burial.

Image: SARASOTA, Florida (AP) -- The brother of a man accused of abducting and killing Carlie Brucia wiped his eyes Wednesday as he recounted his sibling's account of sexually assaulting and killing the 11-year-old the girl. John Smith testified that his brother, Joseph Smith, told him that he had "rough sex" with Carlie and then strangled her. The abduction was captured by a security camera at a car wash and broadcast worldwide on television. Details of her slaying came four nights after Carlie was abducted, the witness said. His brother was in jail and John Smith was leading detectives to the location where his brother told him the girl's body might be found. Joseph Smith, a 39-year-old former auto mechanic and father of three daughters, is charged with first-degree murder, kidnapping and capital sexual battery in Carlie's death. He has pleaded not guilty; if convicted, he may face the death penalty. Joseph Smith met with his brother and their mother, Patricia Davis, in jail shortly after his arrest. He confessed to his role in Carlie's disappearance under their questioning, his brother testified. Mumbling and occasionally closing his eyes on the witness stand, John Smith recounted the jailhouse conversation. His brother told him he had intercourse with the girl and made her perform oral sex. Davis left the room crying, and the brothers cried and "were hugging each other close," John Smith said. After leaving the jail, John Smith and Davis drove to a nearby church where Joseph told him they might find Carlie. They didn't find the body that day. They didn't immediately tell authorities about their conversation with Joseph because, John Smith said, "I was thinking, maybe, the child was still alive." The defendant's mother and brother went to authorities later that night, and John Smith led investigators to the scene. Carlie's body was found the next morning. Deputy Michael Davino, a Sarasota County corrections officer, told jurors he overheard phone conversations Joseph Smith made from jail to his brother and mother that night. During one call, Davino testified, Joseph Smith told his brother, "She's between two trees, not too far back, maybe around the tree line." Joseph Smith also asked his brother to apologize to their mother for what he had done and for "what he was putting his mother through," Davino said. John Smith testified that he had recognized his brother in the videotape shown to jurors Tuesday as the tattooed man in a uniform grabbing Carlie's arm and leading her away. Several others, including Joseph Smith's business partner, testified Tuesday they also recognized him on the tape. Under questioning by a defense attorney, John Smith acknowledged he hadn't talked to his brother in a couple of months at the time of Carlie's disappearance because of a feud. He also conceded he asked investigators about a reward, but said he was interested in it because his brother wanted to use the money to set up a trust fund for his children. the truth this man speaked reminded me or someone else i knew...he knew his brother is a monster and he still loves him but for what i believe, that little girl he is doing this for...he might be forced into testifying but he speaks from the heart...he is a man with a conscience and his brother isn't...he knows his brother is a cold scumbag killer who raped and did horrible things to that little girl...this man might have his problems with drugs or whatever but he is doing the right thing and he in my eyes is a hero for doing it...he knows his brother shouldn't be allowed to live for what he did and i respect that with everything i have I believe that post came straight from your heart Bryan. I hope you know how much I respect you. Not that it matters but I gave you a point. Thank you for sharing so honestly

Tx Girl, I'm an anti too, but do you have any children? Do you ever wonder how it would feel to lose a child? These parents had their children's lives stolen. And not only were their lives snuffed out, but they were taken in the most unimaginably brutal way....something their parents live with everyday. These parents will never see their daughters graduate or marry. So not only did these murderers steal their children, they took away these parents futures.
I find it very difficult to muster any sympathy for any sufferings the murders endure in prison. And if I was going to change my stance, this would be the kind of case that would sway me to the other side.

Jesus Garza was an athlete who played both football and baseball for Ryan as a sophomore. He was interested in art, and he met Cari Crews in an art class the semester before they died.

So much focus on the perpetrator with an execution date looming, that I wanted to remember Brandon. So sweet, innocent baby, Brandon Baugh, this is for you. He was really tiny," said Brandon's mother, Melissa Baugh. "He was really sweet. Great baby." In pictures, his bright, brown eyes and sweet smile are reminders of all that would never be. As Eryn put it, "So many hopes and aspirations that I had for Brandon, and all those were just taken away in a moment of her rage."

She was a member of the Future Farmers of America, and showed pigs at the Travis County Rodeo. She loved George Strait and cats and wanted to be a veterinarian. Her brother remembers her as being popular and vivacious. Her principal said was a model student who got good grades and participated in extra curricular activities. She was 13. Jennifer Ann Harbison - Born May 9, 1974 Jennifer attended St. Louis Catholic Church and was a senior in high school. She was captain of the FFA and her school's drill team and ran track. Jennifer was opinionated and outspoken, with a wacky sense of humor, she was a leader in her government class at school. She was 17. Sarah Louise Harbison - Born October 28, 1976 Sarah was in 9th grade and a junior varsity cheerleader. She was a member of the student council and the FFA. Sarah showed lambs at the Travis County Rodeo and collected sea shells. She was 15. Eliza Hope Thomas - Born May 16, 1974 Eliza was a senior in high school and also attended St. Louis Catholic Church. She enjoyed country dancing and raising pigs. The last pig she raised, Lucille, made in to the auction at the Travis County Stock Show. According to her Dad she loved animals and kept 4 crayfish in a pan in her bedroom, as well as white rats. She wanted to be a vet and a rancher. She took her studies seriously, and would often stay up late at night, to finish her homework. She was 17. These four girls were murdered December 6, 1991, in what has now become to known as the Yogurt Shop Murders in Austin, Texas This tribute was written by their classmate Amber We love them all with our heart and soul We hated to see them go God has taken them under His wing For they are at peace and the angels will sing As time goes on the pain will fade Loving memories and happy times are soon to come to help us through the longing days As life moves on as we know it will "For Jennifer, Sarah, Eliza and Amy Your memory lives on and we love you all."

I would like to share a pic of my father but I am scared that some one will take it and use it in a bad way. Its why I no longer use his pic as my avatar. Shawni, I understand your feelings (truly, I do) ~~ but, if we let those who would hurt us this way keep us from sharing our loved ones, seems like they win, and like we're all the losers for it. I would so love to see your father's face again. {{{{{Shawni}}}}} I agree with Lynne, Shawni, if you let these evil and twisted idiots silence your voice, then they have won, and others won't get to know what it's like or come to understand, the hurt you live with everyday after the loss of your father, and the others like him, who have been selfishly taken. Austin police investigate fatal stabbing; Police are investigating a fatal stabbing that occurred early Sunday in Southeast Austin. At 3 a.m., police responded to a call that a man had been stabbed during an altercation in the 2300 block of Blue Meadow Drive. The victim, 24-year-old John Lewis Reynero, was taken to Brackenridge Hospital with life-threatening injuries; he underwent surgery but died at 7 a.m. Police are investigating what prompted the altercation and are searching for a 5-feet-5-inch Hispanic male, age 18 to 19, in connection with the stabbing. Austin police are investigating a homicide in the 7000 block of Decker Lane in Northeast Austin near Walter E. Long Municipal Park. Officers were in the Huntington Meadows apartment complex at around 1:41 a.m. this morning when they heard an altercation in another part of the complex. They went to where the altercation was and found a Hispanic man with injuries from the fight. Officers called EMS paramedics and the man was pronounced dead at the scene. His name was not released pending identification and notification of his family members.
