Man Who Hanged Toddler From Shower Rod Gets Prison Time
POSTED: 7:57 am EDT April 21, 2005
NEW YORK -- A man who hanged his 2-year-old son from a shower curtain rod to get revenge against the boy's mother was sentenced Wednesday to 22 years to life in prison.
Juan Batista, 28, showed no emotion as the judge handed down the sentence. He pleaded guilty last month to second-degree murder.
Prosecutor Robert Masters told the court no amount of prison time was adequate for the 2003 killing of Omar Arias.
"When his son was in most need of a father, he found the cold, cruel, deliberate hand of a murderer," Masters said. "(Batista's) hatred for the mother of his own flesh and blood was greater than any affection he had for his child."
Batista and the toddler's mother had broken up after a four-year relationship, and he had asked to take the boy overnight following a confrontation with her new boyfriend.
Prosecutors said he took the child to a motel, hanged him with an extension cord on the shower rod and went to the front desk to report what he had done.
The toddler's mother, Alexandria Arias, asked a relative to read her statement to the court. It said: "There is no punishment that can bring back my beautiful angel to me."

This man deserves to the death penalty! There are no questions about the fact he killed his child. The death penalty should have been impossed, a date set and the job carried out. This is a parasite that we will have to support for the next (maybe) 22 years plus!
What is wrong with the judical system? Although he killed his son out of revenge, if he had gotten the death penalty, he would have drug this through the court system for the next 20 years fighting for his own life to be spared!
What's your thoughts on this outragous sentencing?
Thanks for letting me vent!

For some reason those who kill their own family members aren't considered as dangerous or threatening to the general public, and therefore often receive more lenient criminal charges or sentencing. I see this all the time.
It's crap if you ask me but that's how jurors are.

Windy, you are also forgetting that New York doesn't have the death penalty.

Windy, you are also forgetting that New York doesn't have the death penalty. LWOP then. In my eyes, he should have got the DP hands-down. This 22-year to life is outragous.

You're right! No death penalty in NY... It's sad to know this child's life, his own child no less, wasn't that important to him. He was mad at the girlfriend, kills their child to get even with her, now we get to house, feed and clothe the SOB for the next 2 decades plus. Time to go back to the chain gang and have them do public service for all of that time and not expect to be cared for by other people. Something needs to happen with them, at this rate, they'll end up out numbering the rest of us!
Nice meeting you too Emperess and Joseph! ;D Hope to 'talk' with you again!

You're quite welcome, Windy. Check out these two vicious multiple-murders, only about four miles from my apartment, both within 2 years: da.co.la.ca.us/mr/032905a.htmda.co.la.ca.us/mr/102203a.htmIn the more recent case, the trial is still on. The jury is about to decide LWOP or DP. Since the murderer has a sob story (boo-hoo, my wife left me, etc.) he will probably get away with LWOP. Such a damned shame.
