As many of you may know, there is a research effort underway by Michael Welner, M.D. a forensic psychiatrist from the NYU School of Medicine, where he is attempting to standardize legal distinctions of "evil" crimes. 39 states in this country allow the judge to assign a harsher sentence for "heinous", "atrocious", or "cruel" crimes, but there is NO objective means to measure these legal terms. One result that often happens is that Prosecutors will not seek the DP because they arent sure if the jury will consider their case to be exceptionally depraved. When Welner's Depravity Scale is finally published, this tool will assist prosecutors in claiming that their case really is in fact a heinous crime and will have the empirical base to prove that!!!
