Lionel Tate was the boy in Florida who was found guilty of first-degree murder and sentenced to LWOP for the death of a six years old playmate. He was 12 years old when this happened.
My questions:
What circumstances of the case made this a case of first-degree murder under Florida's law as opposed to second- or third-degree murder or a lesser charge like manslaughter?
The theory of the defense was that the death of the girl was the result of an accident which happened when Lionel Tate imitated professional wrestling moves. What was the theory of the prosecution to counter the claims of the defense and to justify their charge of first-degree murder? What was the evidence to support the theory of the prosecution?
What is the current state of affairs in this case now?
I searched the web for information on the case to answer my questions, but could not find much. Without further information, I find it hard to grasp how this case could result in a first-degree murder charge, let alone a conviction for that charge. I appreciate any answer which sheds some light on the facts of this case.

He is under house arrest for a year, I believe. I do agree, though, that he bears close scrutiny. Something is very wrong with him. He is out now. Hope everybody in FL keeps a close eye on their little girls.

The autopsy showed that Tiffany had suffered a crushed skull, broken ribs, more than 30 internal bruises. Her liver had been shredded and pushed through her rib cage. Those are the injuries suffered by his victim. He was young, but the severity of the beating and his total lack of any emotion when the victim's mother talked about her daughter shows his antisocial personality. Life was probably too long, but 3 years was way to short.

I personally do not think they should have just let this killer off.....but should have stayed in juvinile until he wa 21 then sent to prison to serve the rest of his sentence.
