Court asked to determine right of policemen to use horsewhips on citizens By Ise-Oluwa Ige Monday, July 07, 2003 LAGOS—A Federal high court sitting in Lagos has been asked to determine whether in a democracy like Nigeria, security agents including policemen can lawfully carry horsewhips and use them, at will, on citizens like task masters in a slave camp. Staff of a human rights group, Female Leadership Forum (FLF), one Olaide Kasim who wants the court to determine the legal question is also asking, Justice Nwodo to determine whether carrying horsewhips by men of the Nigeria Police Force (NPF) falls within the contemplation of Section 4 of the Police Act, Cap 359, Laws of the Federation of Nigeria, 1990. The section spells out the general powers of police in preventing and detecting crime, apprehending offenders, preserving law and order, protecting life and property and enforcing all laws and regulations. The case is being prosecuted on behalf of Kasim by the law-firm of Mr Jiti Ogunye. Kasim was whipped mercilessly by two mobile policemen at the premises of Prudent Bank Ikeja where he had gone for a banking transaction in September last year over alleged wrongful parking. Named as respondents in the suit are the Nigeria Police Force, the Nigeria Police Council, the Inspector-General of Police , the Federation Attorney-General and the Prudent Bank Plc Should the court hold, after arguments in the matter, that it is unlawful for policemen to carry and use, at will, horsewhips on Nigerians on the grounds that such power is outside the contemplation of the police act which established the NPF, the plaintiff wants the court to compel the police authorities to pay him N1million damages for breach of his rights to human dignity. odili.net/news/source/2003/jul/8/49.html

It sounds like it was inappropriate to whip him as much as they did.

I just want to commend the chamber of Mr Jiti Ogunye for this outstanding job . I am surprise at the way the Nigerian Police still go about treating citizens. But I am also glad that this chamber is vigilant and courageous to take up this case.
