Spears has not taken any legal action since his sentencing. He appears to be a volunteer.
Steven Frederick Spears, 44, sat motionless next to defense attorneys as the decision was read and said nothing before being escorted out of the courtroom by Lumpkin County deputies. Spears was convicted Wednesday of choking to death 34-year-old Sherri Holland in August 2001 at her Dahlonega home.
Jurors deliberated for more than two hours Thursday before sentencing Spears to a total of three death sentences for convictions of malice murder and two counts of felony murder.
Spears told investigators in the hours after his arrest that he had warned Holland at the beginning of their relationship that he would kill her if she replaced him. Several months after Holland ended their relationship, Spears plotted her murder by setting up what he needed to kill her in any of four different ways — electrocution, beating, shooting or suffocation.
He ultimately chose suffocation.
His last meal request was for a large meat pizza. Pretty simple.

He appears to be a volunteer. As far as I know, in all the death penalty states, inmates to do not need to consent to appeals filed on their behalf. He can "volunteer," but his fate is not up to him any more.

That's how I understand it as well. Don't know why though. Everything changed after the Gary Mark Gilmore execution. Defendants could no longer plead guilty to capital murder, and on conviction could not forgo appeals file on their behalf.

Steven Spears, who never fought his death sentence, died by lethal injection Wednesday night, becoming the eighth person Georgia has put to death this year.
He was pronounced dead at 7:30 p.m., executed for murdering his ex-girlfriend, Sherri Holland, in 2001.
