Before criticising the judges who voted FOR the execution of "Yellow" Williams , I wonder what one should think about judges who do everything in their power to prevent justice, disregard the will of the people and manipulate the law of the land? Judge Eric Clay and his four dissenting colleagues should hang their heads in shame, and preferably resign if they are incapable or unwilling to carry out the laws they swore to uphold. Appeals Court Judge in Ohio Says Vote Was ImproperThu Jan 15, 5:54 PM ET story.news.yahoo.com/news?tmpl=story&cid=1896&ncid=1896&e=12&u=/nm/20040115/us_nm/execution_court_dc_1CINCINNATI, Ohio (Reuters) - A federal appeals court judge criticized two colleagues for voting improperly to turn down a request for a stay by a condemned man who was executed this week, according to court documents released on Thursday. The dissenting opinion written by 6th Circuit Appeals Court Judge Eric Clay, joined by four of his colleagues on the 12-member court, said two senior judges should not have cast votes on the issue of granting a stay for Lewis Williams. Clay wrote that the senior, or semi-retired, judges could only vote if the full court was considering the decision of a three-judge panel, which it was not doing in this instance. The votes by the two senior judges swung the court's decision against granting the stay, Clay wrote, though the voting breakdown was not given. The appeals court in Cincinnati has become well-known for bickering among its members, with judges often airing their differences in dissents that cite opposing colleagues by name. Williams' lawyer, Stephen Ferrell, said the U.S. Supreme Court (news - web sites) would have vacated the stay for his client in any case. Williams was executed on Wednesday, but struggled with his guards up until the lethal drugs were administered, in what witnesses described as an agonizing, traumatic experience.
