This thread is to discuss the possibility that someone will actually be given a death sentence for a non-murder crime. Currently their is 1 inmate in the US on death row for a non-murder offense. Demarcus Ali Sear is on death row in Georgia for Kidnapping resulting in serious bodily injury. Child rape is no longer punishable by death because of the Kennedy vs. Louisiana ridiculous decision, but could they revoke that? Discuss.

From what I read about this it is pretty much a murder charge, he just happened to kill the victim in Kentucky and not in Georgia.

He was never charged for that murder. Innocent until proven guilty. He is on death row for kidnapping.

Critics of the DP for non-murder crimes suggest that criminals would be more likely to kill the victim because they could get the DP anyways.
I don't know if criminals are rational enough, nor the DP used enough for that to be a factor.
What I don't get is that there's 100 death sentences handed out a year - so quite a few murderers getting less than death, and now you folks want to expand the DP? How about you clean up and use the laws you have folks.

The SCOTUS has pretty much said (last year I think) that the DP for rape (adult or child) is unconstitutional. If you don't have a dead body, I don't think the SCOTUS would uphold a death sentence at this point.

Hey, anti are specifically plucked out of juries, and yet only 100 sentences came down last year? I think the antis are the least of your concerns.

If you commit murder you should be eligible for the death penalty.
If you don't, then you shouldn't.
That's a pretty consistently moral position.
Otherwise you're executing people who HAVEN'T killed anyone which is obviously morally wrong.
