Nancy Grace, Wendy Murphy, and Susan Filan, these are all the names of high profile television personalities that originally supported the prosecution in the beginning stages of the Duke rape case. And it wasn't just them, much of the public supported Mike Nifong and the prosecution when it came to light to 3 Duke lacrosse players had been charged with rape.
In the beginning, Mike Nifong came out to the press and gave dozens of interviews. He was firm in his belief that a rape had occured and that Duke lacrosse players were guilty. He made statements to the public that made it seem as if there was absolutely no doubt in his mind that a rape happened, and there was also no doubt that he was going to go after the perps.
Nifong got much of the public and key players in the media to support him in the beginning. Even I supported him, and I wanted to go after the perps of a horrible crime. When the information came out that the victim had a shady backround and credibility problems, I didn't think that mattered one bit and I was furious with the people in the media jumping a board the defense's ship just because of the accusser's circumstances. It is my belief that when a rape victim comes into a DA's office and tells them that they were victimized, nothing but the truth regarding the crime matters. It doesn't matters the victims age, gender, race, occupation, how they look, where they come from, wether they went to college or if they didn't... none of it matters, and I immediately blamed media players like Sean Hannity for supporting the defense. I thought they were only doing it because the accusser happened to be an African American with an occupation some might find not very tasteful.
When the DNA evidence came out that it did not match those charged, I didn't care and I immediately ran to the cabinet of explanations for why a rape might not carry any DNA evidence. The District Attorney Mike Nifong still supported the victim, so did I. When the defense came out with their evidence that seem to make it impossible for the 3 defendants charged to be guilty of the crime, I didn't care. I mashed it up to just be all defense spin and I steadfastly maintained my trust in DA Mike Nifong and the prosecution's case. When report after report came out that the accusser "changed her story" I chalked that up too to be defense spin. I even went a step further, and maintained that the accusser might have been suffering from post-traumatic stress disorder, and couldn't remember all of the events of that night.
I went out of my way to maintain my trust in the prosecution's case, Mike Nifong's case, the public official's case and there was going to be nothing on earth that could change my mind until we heard all of the facts come out in a court of law, in a fair trial with an inpartial jury, and then they would make the decision. Well almost nothing.
I as well as other people put my trust in Mike Nifong. Because hes the DA. Because hes the public official who took an oath and swore to do justice. Because I usually trust public officials, because I believe they are out to do justice. If asked to choose between the defense or the DA, I'm going with the DA any day of the week. But recently it came out that DA Mike Nifong wants out of the Duke Rape case, and a special prosecutor to be appointed. What am I supposed to do now? Remember this is the same Mike Nifong that I put all my trust into. This is the same Mike Nifong that I supported all throughout this case in the face of an overwhealing defense team. And now the public official wants out of the case?
So what is my conclusion about the Duke rape case at this point? Well I still believe that nobody will ever know if the accusser was raped until it is proven in a court of law. But there is one thing that we all can know, and that is that this accuser has been victimized, by Mike Nifong. She has been victimized by the man who swore to do justice in North Carolina. By the District Attoreny. By the public official. By the person that we the public entrust and believe will do the right thing. Yet, there are already allegations that the man who swore to do justice has been hiding DNA evidence, telling lies to the press, and abusing the power entrusted to him. What can we as Americans get out of this case, one fact and one reminder that the public officials we entrust to do justice don't always have the interests of justice on their mind.

Larry Harriet, I know this woman wasn't raped. There is NO evidence to show she was raped. NO evidence. If there isn't any evidence she was raped. Then I come to the conclusion that she is a lying dirtbag & that prosecutor, (who now has his tail between his legs). is an out of control maniac & a lying fraud.
Our country is in REAL danger when some Durham dirt-bag can made false accusations against members of a lacrosse team. DNA evidence collected & showed that there was no reference to any rape. Yet the prosecutor STILL went forward! DNA testing failed to connect any of players to the alleged attack on that nasty stripper who lied when she said she was raped.
In America, you're supposed to be innocent until proven guilty. They take 20 boys, they take their DNA because a dirty, verminous hooker said she was rape & it turns out she is a liar. The DA needs to be impeached & the AV needs to PAY all the legal fee's of the innocent defendants.
The Durham dirt-bag case disgusts me, that drunken *deleted* stripping fraud accusing men of raping her when there is absolutely no evidence of such a rape other than what comes out of that nasty mouth of hers. It is one of the most disgusting cases I've ever seen.
She has made a RECREATIONAL SPORT out of crying rape & that is ASHAME to the REAL RAPE VICTIMS in the country.
CORRECTION: NANCY NEVER SUPPORTED PROSECUTION. She never called it 1 way or the other.

Thanks for pointing that out.

Didn't the "victim" go on to admit that she wasn't sure after all, whether penetration took place or not? Implausible. I will say that I think this DA should never be allowed to prosecute another case in his lifetime. I'd have to know more than I know from the sidelines to form an opinion as to whether he should be disbarred permanently, though. I'm leaning in that direction, though.

Well I think he should be disbarred permanently. If we can do that to Clinton for dropping his pants to a skank like Monica Lewinsky we can surely do it to Nifong for this: The head of a private DNA laboratory said under oath today that he and District Attorney Mike Nifong agreed not to report DNA results favorable to Duke lacrosse players charged with rape. Brian Meehan, director of DNA Security of Burlington, said his lab found DNA from unidentified men in the underwear, pubic hair and rectum of the woman who said she was gang-raped at a lacrosse party in March. Nurses at Duke Hospital collected the samples a few hours after the alleged assault. Meehan said the DNA did not come from Reade Seligmann, David Evans, or Collin Finnerty, who have been charged with rape and sexual assault in the case. Meehan struggled to say why he didnāt include the favorable evidence in a report dated May 12, almost a month after Seligmann and Finnerty had been indicted. He cited concerns about the privacy of the lacrosse players, his discussions at several meetings with Nifong, and the fact that he didnāt know whose DNA it was. I feel real bad for the young men involved. I can only speak for myself, but being falsely accused of rape would be one of the most horrible things I can think of. Especially in a high profile case. In a certain sense, I would rather be wrongly accused of robbery or even murder than sexual assault. Perhaps this experience will inspire one of the accused to pursue a career in law. They would certainly have a compelling story to write in their personal statement for a law school application.

Ya, it was an editorial, but I wrote it so I guess I have the right to post it here. The thing is, it reads like you're explaining, or apologizing, for previous comments or positions you've taken regarding the Duke case. But you haven't taken them here. So the whole post seems somewhat out of place, and odd.

I am left in the dark. The question in the media has shifted from was this woman raped? to what should nifong be charged with? I think its a disgrace when a public servant acts like this. Was this woman raped? I can't say she was. If you're in the dark it was by choice. No matter what the evidence you chose to believe what "you" wanted to believe. Do I think this woman was raped no, but if she was it wasn't by them. So even if the one of the other men who's DNA was found in her underwear were charged, I don't think she'd win in court. And I do think Nifong should be charged, as much as they can charge him with. He was willing to destroy other lives to benefit himself so now it would be fitting if his life was ruined for what he did. He deserves it for abusing his power in a "public office" that he took an oath on.

I think that the young men in question were presumed guilty by the press and society even before the evidence was seen. Duke University has had a rough time of it with the people of the town because of income and other considerations by the students there. I believe that nifong saw an opprotunity to kick Duke and took it. I only hope that the young men have their reputaitons cleared and have their lives back and that they could bring slander and libel charges at the prosecutors office and the various news services for this action...

He mouthed a carefully-worded statement his lawyer wrote as part of an agreement to have the charges dropped. I remember watching the coverage of the dismissal of the rape charges Live on Court TV. One of the reporters read his statement & pointed out that he said that he believes that the woman BELIEVED she was raped. It was reported under CO law that if the woman believes she was raped, then she was raped. If he would have made that statement to the police & it came into evidence. There would have been a conviction.

It was reported under CO law that if the woman believes she was raped, then she was raped. If he would have made that statement to the police & it came into evidence. There would have been a conviction. Legally, no one's been raped until a jury says so. The prosecutor was directed by the judge in the Katelyn Faber case not to address the accuser as "victim." There's no way any jury would believe Faber, which is why she dropped out.

Kobe said he believes that she believes she was raped. The CO law is that if the jury finds the woman believes she was raped, then they are to find the defendant guilty.

Kobe said he believes that she believes she was raped. The CO law is that if the jury finds the woman believes she was raped, then they are to find the defendant guilty. Yeah, and maybe Katelyn Faber thought she was Nefertiti incarnate. That doesn't mean squat. It doesn't make a bit of difference what Faber thought at the time, or even that she may or may not have been raped. It was up to her to prove it, and that the accused did it, and she couldn't. So officially she's a liar. Plus there's on way under Colorado law, or under any state law, that a woman's word, and nothing more, can convict a defendant of sexual assault. That whole case was a joke. There wasn't even enough evidence to put Bryant on trial, let alone convict him.

I don't know if she was raped or not. I call Kobe a dirtbag because he cheated on his wife... regardless. As to the woman that said Kobe raped her, I really go back and forth. She was "starstruck" from statements made by other staff she worked with and she willing went to his room. Part of me thinks she had no problem w/sex w/him but when it got rough she freaked out. If she wasn't expecting that, it could be a shock. At the very least he's a cad for cheating and then while he was having sex w/her he did not consider her feelings while performing the act itself (ie getting rough). Two ppl have to consent in order for rough sex to be a great time had by all, otherwise, I could see where it would freak someone out if they put their hands around your throat during sex. Especially someone you do not know and thus cannot trust that they will play it safe, even if rough.

She was "starstruck" from statements made by other staff she worked with and she willing went to his room. Part of me thinks she had no problem w/sex w/him but when it got rough she freaked out. Or maybe she thought she could extort money from him -- which she did.

There is no evidence to suggest rape w/ the Durham Dirt bag Hooker. But on the Kobe issue. The alleged victim had blood in her underwear. Injuries to her vaginal area. Bruising on the face. Witnesses seen her clothes torn & tattered. Said she was VERY emotional afterwards. I think she was raped. Unlike the Durham hooker.
