Court rejects Charles Russell Rhines' lethal injection appealCharles Russell Rhines came one step closer Thursday to his execution sentence for the 1992 murder of Donnivan Schaeffer in Rapid City. Rhines challenged the constitutionality of South Dakota's lethal injection protocol, and Thursday Pennington County Circuit Judge Thomas Trimble rejected the challenge. Rhines claimed that South Dakota's single drug lethal injection protocol is cruel and unusual punishment. He said he faces a substantial risk of pain because the potency and proper administration of the drug is not assured by the current methods. The court found that South Dakota's single drug protocol does not pose a risk of unconstitutional pain and suffering. "Lethal injection is the most humane manner of implementing the death penalty," wrote the court. The court concluded that South Dakota's protocol is similar to and in some respects more protective than the protocol approved by the United States Supreme Court. Good. No reason why a single drug would be declared cruel and unusual. You just get the drug and you fall asleep.
