Man who killed, raped Lodi girl wants execution blockedSAN FRANCISCO - Michael Morales, who is scheduled to be executed next month for raping and murdering a 17-year-old Lodi girl, claims injecting him with lethal amounts of poison to end his life is unconstitutionally cruel and unusual punishment - a claim the U.S. Supreme Court never has endorsed. Morales, scheduled to be executed Feb. 21, would become the third inmate put to death in California since December. Condemned California inmate Donald Beardslee, who was executed last year, made similar claims that were rejected. In court briefs filed Friday in San Jose federal court, attorneys for Morales allege a mistake in the sedation process might mean he would appear unconscious, but internally would succumb to excruciating pain once the paralyzing and the death drug were administered. Morales could be "paralyzed but conscious and suffering death from ... burning veins and heart failure," attorney David Senior wrote. A hearing is set for Thursday. The U.S. Supreme Court has never directly addressed whether death sentences carried out by lethal injection are cruel and unusual punishment. The justices have upheld executions in general despite the pain they might cause inmates, but have left unsettled the issue of whether alleged pain in lethal injections is unconstitutionally excessive and can be avoided. Most of the 36 states that perform lethal injections use the paralyzing agent - pancuronium bromide - after a sedative is given. California attorney general spokesman Nathan Barankin noted that lethal injection challenges have not prevailed. "We expect that Morales' lawsuit will also be unsuccessful," Barankin said. Morales, 46, of Stockton, raped and brutally beat a 17-year-old Lodi girl 25 years ago. Terri Winchell was found beaten and stabbed in a secluded vineyard. It's a standard appeal issue and hasn't been given credence yet. I doubt it will this time. Morales nears the inevitable hour, and his attorneys are making all the standard gangplank appeals. I expect to find out soon that they've discovered after all these years that he's a retard.

I'm sure the state would be willing to accommodate him, and the courts would not have to waste time on his claim.

And the pain, he caused to the victim of his crime? She was beaten with hammer ,then raped and stabbed four times in the chest. And this bastard will be given only an injection and he will die in sleep. Where does he find the courage to talk about pain? He can be only happy,that the state of California abolished the gas chamber.

Inmates get them all the time, when they are not punching each other in the face with their fists. That one should declare an aversion to a simple needle injection I would file under "chutzpah."

1 or 2 years ago, I read an interesting article about one medium-- he or she transfered himself into the mind of the man recently executed by guillotine. Later, the medium said, that the head of this executed inmate was alive a few seconds after the decapitation and was able to recognize what happened to him.True or not-- I donĀ“t know...

In the version most recently used, I believe, the condemned prisoner does not even have to bend over. S/he is strapped to a plank upright, and when the switch is pressed, the condemned and the guillotine blade come down in unison. It all happens in a split-second. Gotta hand it to those Frenchies. They may be cowards and reek of body odor, but they gave us a great method of execution. I don't know why we never employed it.

The head probably stays conscious for perhaps 15 seconds.

Actually, I was thinking more along the lines of some type of contraption that would be attached to him and drain him of blood and slowly (or quickly) put him to sleep Just to avoid any "burnng veins" issues. The Red Cross could have the blood, maybe organs could be harvested, who knows? I would think inmates who are really really sorry and have found God and wish they could make up for their crimes but know they can't bring their victims back would jump at the chance to give life to who knows how many people, right? Never heard of live embalming and I'm almost afraid to ask...
