The parties have reached an agreement to allow DNA testing and an order was entered by the CCA on June 20, 2012 returning the case to the trial court for entry of an agreed order. You can find the order at Skinner's site (www.hankskinner.org), under "Legal Documents." Essentially, the various biological materials not tested by the defense at the time of the original trial will now be subjected to DNA testing. Ultimately, there will be a hearing within 45 days of the results being received by the parties and the court.

Donnell, Skinner's alternate suspect, has been eliminated as a donor of one of the the hairs in Twila Busby's hand, since he was a maternal uncle and would, therefore, possess identical MtDNA. There is an unknown hair, but according to Skinner's own statements to police, Twila's ex-husband was allegedly in the house that day and he told police he caught her in bed with her ex-husband on New Year's Eve 1993. Howard Mitchell was also in the house and the hair could belong to him. Neither of those men were ever raised as alternate suspects by Skinner, however. When the DNA doesn't identify an unknown party, he will still claim that he's innocent, even though the DNA proves otherwise. It appears that the DNA testing has been officially ordered by the trial court. www.mysanantonio.com/news/local_news/article/New-hope-problems-for-death-row-inmate-3687153.phpkma367

Oh, it's looking bad for old Hank. At least he pushed for DNA testing.
However, it's not like there aren't real innocent people (look up Anthony Graves and Michael Morton) out there.
