The crime took place in 1998? Is Georgia faster than I expected, or is Rhode a volunteer? I thought the same thing, but it looks like he's just finished his appeals faster than usual.

Clemency was denied Friday to a Georgia man condemned for a 1998 triple murder. The relatives and supporters of Brandon Joseph Rhode asked the state Board of Pardons and Paroles for mercy five days before he is scheduled to die by lethal injection.
The board voted Friday to deny clemency.
Rhode was not at the board appointment, but his supporters had private meeting Friday morning. Only the courts or the Pardons and Paroles Board can stop an execution in Georgia.
Rhode would be the 25th person in Georgia to die by lethal injection and the 48th the state has executed since the U.S. Supreme Court reinstated the death penalty in 1973.
Rhode's execution is scheduled for 7 p.m. Tuesday.
Rhode, born in 1979, and a partner, did not set out to commit murder when they broke into the Jones County house of Steven and Gerri Ann Moss on April 23, 1998, according to trial testimony.
Their plan was to commit a burglary.
But 11-year-old Bryan was murdered when he came home from school, then his 15-year-old sister, Kristin, and then their 37-year-old father, Steven Moss.
According to testimony, Rhode and Daniel Lucas made two trips to the Moss house that day. The first time they left without taking anything because the alarm went off.
They came back later that day.
Bryan Moss was the first to come home.
The boy could see the two men through a front window as they were ransacking the house. The boy, armed with a baseball bat, came in through the back, but he was subdued by Rhode and Lucas, who were armed.
They put him in a chair as they discussed what to do with him. They were still talking about their options when Lucas shot the boy in the shoulder.
Moments later, Kristin Moss was seen coming up to the house, so Lucas took Bryan to a back bedroom while Rhode waited for the boy’s sister.
Rhode put her in the same chair and shot the teenager twice.
Simultaneously, Lucas, in the back with Bryan, shot the boy again.
Rhode shot and killed their father when he got to the house.
Then the partners shot the Moss siblings several more times to be certain they were dead.
Lucas, born in 1978, is also on death row for the murders.

Brandon Joseph Rhode, 31, tried to slit his wrists and his throat, according to his attorneys who want to halt the execution with a new mental competency challenge.
Rhode's attorney Brian Kammer said the attempted suicide proves Rhode was "incompetent" and executing him violates the Constitution's ban on cruel and unusual punishment.
"He's utterly terrified and just hopeless," said Kammer. "He was very morose, frightened and subdued. This was a product of him just being in terror, of losing hope altogether."
Georgia prisons officials have rescheduled the execution for Friday.
Rhode was convicted in 2000 of the killings of Steven Moss, 37, his 11-year-old son Bryan and 15-year-old daughter Kristin during a burglary of their Jones County home. His co-conspirator, Daniel Lucas, was also sentenced to death in a separate trial and is on death row.
Suicide attempts on death row are rare, but have happened. In March, Ohio inmate Lawrence Reynolds overdosed on an antidepressant hours before he was to be transferred to the state's death chamber. He recovered in a hospital and was executed a week later.
In Texas, David Long was executed in December 1999 after overdosing on antidepressants authorities believe he hoarded in his death row cell. Long's attorneys sought to postpone the execution, but a judge refused a reprieve, saying that because Long previously was judged competent to be executed, there was a presumption of competency.

Brandon Rhode is due to be executed in Georgia, at 9 am on 24 September 24. He was due to be put to death on the evening of September 21, but his execution was stayed by the Georgia Supreme Court after he attempted suicide. He was only 18 at the time of the crime, with developmental problems, and his suicide attempt calls into question his mental health. Call on the Georgia Board of Pardons and Paroles to reconsider their denial of clemency and stop this execution.

A request for stay of execution for Brandon Rhode was denied by a federal judge Thursday. The execution of Brandon Rhode remains scheduled for 9 o’clock Friday morning. It represents a re-schedule of the previous date on Tuesday of this week—following a suicide attempt by the death row inmate.
On Thursday, a federal judge rejected a request by Rhode’s lawyers to delay the execution. In his order, the judge said it was “very troubling” a disposable razor was used in the suicide attempt. But the judge also said Rhode’s attorneys don’t need more time to investigate the incident.
Rhode is to die by lethal injection for the killings of a father and his two children in Jones County in 1998.

ATLANTA — A federal judge Thursday denied a condemned inmate's request for a stay of execution so an investigation can be carried out to find out how he got razor blades and used them to try to commit suicide hours before his scheduled execution on Tuesday. But U.S. District Judge Bill Duffey ordered the Department of Corrections to make sure Brandon Rhode is no longer a danger to himself. The DOC's existing protections did not prevent him from seriously injuring himself, the judge noted. Rhode, convicted of a triple murder, is scheduled to be put to death by lethal injection at 7 p.m. today. Duffey ordered the DOC to search Rhode's cell for all razors, belts or T-shirts and to remove them if any are found. Two guards — and not the guards who were assigned to watch him when he tried to kill himself — must continuously observe Rhode, the judge said. During a Thursday morning hearing, Rhode's lawyer, William Montross, said guards gave two razor blades to Rhode before he tried to commit suicide. Montross asked Duffey to delay the execution so an investigation can be conducted to find out what happened. Joe Drolet, a lawyer for the state attorney general's office, opposed the request and disputed the allegations, saying Rhode had only one razor blade. Rhode had concealed the razor blade he used to cut his neck and arms while lying under a blanket, Drolet said. At that time, he was being observed by guards, but they could not see what was happening under the blanket and took action when they saw blood. "There's not a pattern of recklessly handing out razors to suicidal death row inmates," he said. Duffey said he was very troubled by what happened. "What I've seen so far is not only disturbing to the court, it's disturbing to the public." In his order, Duffey said he was denying the stay because his instructions to protect Rhode from cruel and unusual punishment before his execution. Rhode's lawyers are appealing. We said it was unlikely, but at 4 p.m. — just three hours before his execution was to be carried out — Brandon Rhode was granted a second stay of execution by the Georgia Supreme Court. Rhode was initially granted a temporary stay when on Tuesday he attempted suicide with the blade from a dismantled disposable razor, a razor given to him by a prison guard.
Since the suicide attempt, Rhode's attorney Brian Kammer has argued that his client is not competent to face execution. He filed a motion this morning for an emergency stay based on Rhode having been deprived a "meaningful proceeding" under state law. Nine hours of court proceedings were held in Butts County — at least in part during the night — to determine whether Rhode is competent to face execution, but a psychiatrist appointed by Rhode's counsel was not given the opportunity to attend and a transcript of the proceeding was not made available to Kammer until 10 this morning. In his motion, Kammer says the stay will give "a real opportunity to examine the transcripts of the proceedings" and, as such, to file any appeals.
Rhode was convicted in 2000 of murdering three members of a Jones County family — Steven Moss and his two children, Kristin and Bryan, ages 15 and 11, respectively — during a burglary.
The stay expires at 4 p.m. on Monday, September 27.

The USSC denial and the Georgia Supreme Court grant, may be two different things.
I have a feeling that the defense filed with the US Supremes on what they had regarding competency and were denied.
However, they were able to obtain a stay from Georgia Supreme Court to be able to present additional evidence to the state court on his lack of competency with the stay to expire at 4 pm. If Georgia denies it, they will appeal to the USSC again.

If this was an "attempt," I'd have to say it was a serious one. But, hey, sucker-you don't die until we say you die.
