This is a survey. Newton is a 39 year-old black woman on Texas' death row scheduled to die by lethal injection at 6:00 p.m. EST today at Huntsville for the 1987 murders of her husband and two children. The evidence used to convict Newton, though quite compelling, was largely circumstantial. Recent revelations that Houston Police Department (HPD) Crime Lab analyses involving some 200+ criminal cases may be tainted forms the basis for Newton's latest appeal requesting Texas Governor Rick Perry grant her a 120-day stay of execution. Who is it going to hurt to test the weapon and the skirt? Her first ineffective counsel certainly didn't care to. She's not going anywhere or is it that some people think the testing may just go in her favor??

It is glaringly obviously that these last minute ploys are just attempts to prolong her life and have nothing to do whatsoever with guilt or innocence.

So GlennF, when exactly do you file a claim for your insurance? After the funeral, when my father died I remember my mother doing it as soon as possible to help with the burial expenses. Sometimes you don't get into the limelight for anyone to help you until the last moment. Sure other lawyers could have popped up but they didn't. She sure can't make it happen from death row. For you BossKean, she took a gun to the apartment...it was never proved it was the gun that killed her family. That's why her lawyers want the extra time.

Wrong! The ballistics test by HPD proved her's was the death weapon. Her new lawyers contend the test results may - repeat, may - have been flawed due to problems within the HPD crime lab at the time.

If should not take 120 days to test a bullet from the gun they have.
Test it, if it's her's, execute her
She has had all these years on DR to get this testing done...I do believe that when tested they will find it to be her gun.
But we shall see.

MY QUESTION TO YOU BLACKGURL: The murders were committed on April 7, 1987, and she admitted having the SAME MURDER WEAPON with her when she went to the apartment. Why does it take more than 16 years to ASK for the gun to be tested? Aren't you being just a little riduculos here? She is EXTRA GUILTY...and not just because she is black either, she murdered 3 black people.

First of all I want you to know I'm a pro. But we don't know she didn't want it retested before. First you need a lawyer to take your case then you need the court to grant you the right. I don't think you can just go get it retested. Can you?

The Governor of Texas has accepted the reprieve recommendation and granted a four month stay of execution pending retesting of ballistics from the murder weapon and alleged nitrate gunpowder residue on Newton's clothing.
So far, so good. No one wants to execute an innocent woman. There has been a cloud under the Texas crime lab in recent years so there is value in reestablishing ballistics evidence. Also, apparently the State accepts the defense claim that new technology can differentiate between nitrates from fertilizer and gunpower on 17 year old clothing. If this is also correct, and the evidence is suitable for retesting, then why not confirm the original results?
However, the prosecution needs to hold to two principles:
1. After 17 years, ambiguous results of these selected items do not mean she's innocent since the case was built on a much larger base of evidence. To get her off, the tests must clearly demonstrate she's innocent: and
2. Claims to "ineffective counsel" are just a distraction from physical evidence. If the physical evidence stands, so does the sentence.
Justice has waited 17 years. It can wait another four months to prevent a miscarriage. But if the physical evidence does not exonerate, then Ms. Newton should depart with the tulips next Spring.

I'm sure you're wishing for one, but thus far you're stuck with thug-hugging a list of murderers at the expense of innocent victims and their families. If Frances Newton can use new technology to rebut 17 year old evidence then I am all for it and at public expense. But if new testing does not refute the fresh evidence the jury reviewed at the original trial, then the sentence stands. Laci Peterson's mother let out a primal scream against Scott Peterson at his sentencing phase because he took the life of her daughter so cheaply. By extension, all who hold the life of the murderer more valuable than the life of the victim should be shamed.

All life is valuable. My heart goes out to Laci's mother. I'm sure though the scream she let out is no different the wailing of the mother who has just watched her son be executed. The inmate is now dead and feels no more pain, he's free. What's left? pain for both families.

You are right, the pain of loosing someone never goes away. It never goes away but at least the victims family will have closure. A very good friend of mine was murdered 10 years ago and knowing the three animals that killed him are stealing oxygen from the rest of us angers me to no end. They are not the ones who should be eating, sleeping and breathing.

Every time someone tries to convey the pain of the victims family or the pain and torture the victim most likely endured, you try to cancel it out with the pain of the murdering SOB and his lousy family>..................You irritate me... By wittnessing the execution of my Mother's killer I was able to move past the pain onto another place of only fond memories instead of always having to worry about justice for her killer. chele

A murderer causes pain to: the family of the victim, the friends of the victim, the community where the victim lived and worked, and to their own family.
The pain resulting from the crime, including the pain experienced the criminal's family, is the sole responsibility of the criminal.
I'm sure Scott Peterson's mother is crying tonight since her son has been condemned (whether or not it ever occurs), but her sorrow is Scott's responsibility, not the jury's.

First off, I would like to say that I support the death penalty. In spite of this, I think that innocent people have been convicted and sentenced to death.
However, I don't think Frances Newton is one of them. For me, what leans me towards her being guilty is that she took out insurance on her husband a month before the murder without his knowing about it and while she was living with her boyfriend (the fact that she immediately filed for the insurance didn't help her either).
IMHO, she probably did it.

If murderers don't want to inflict pain on thier families or loved ones, they shouldn't murder.
Feeling sorry for the murderer's family doesn't come into the equasion when it comes to deciding justice for the VICTIM.
We keep putting the victim last, that has to change.
These Anti people that are so magnanamous in thier rational should dig a little deeper into thier souls and realize that the Victim no longer has rights, no longer has a defense, no longer has anything but a family who's life is now ruined. The murderer took away everyone's rights, but the LM's (liberal morons) of this world have succeded in giving the murderer his/her rights. That in one word...sucks.
