The man responsible for killing my nephew is going up for parole and I have to write a letter within ten days explaining why he should not be paroled. I have never written a letter like this before and was wondering if anyone had advise as to the tone of the letter and other important things should be. What should I avoid saying vs. what should I make sure to say and so on... He was only sentenced in November last year- I don't understand how he could be up for parole so soon. He received a 10 year sentence on October 13, 2005 for two 2nd degree felony vehicular manslaughter by intoxication charges and one third degree felony vehicular assault by intoxication charge for the offense committed on 12/18/04. Also, he was additionally given a 2 year sentence on May 5, 2006 (to run concurrently with the 10 year sentence) on a State Jail Felony for marijuana possession for an offense he committed in Maverick County, Texas on October 25, 2004 - prior to the accident causing James' death. Please help... Can anyone write a letter? If so- would anyone be interested?

Make sure you express the "history" of repeated vehicular manslaughters and a separate vehicular assault with a known alcohol and drug abuse record.
I would question what treatment he has taken advantage of that the state provides them free of charge, I would suggest his disciplinary record be reviewed for major/minor cases and the nature of the cases. What other programs he could have attended by choice in order to show remorse and change and ask them if paroled if they would feel confident this man would be safe enough to drive around their children's neighborhoods.

So I have decided to post the email from James' mom:
Dear Heidi and Michele,
I'm sending this e-mail in response to notification I received today regarding Santos Solis, the driver of the vehicle who caused James' death.
According to Texas law, the TDCJ Parole Division is currently processing Mr. Solis' case for parole review by the Board of Pardons and Paroles. I am told this review does not mean he will automatically be released on parole, as each parole release must be approved by a parole panel. This review process normally takes 4 to 6 months to complete.
We have the opportunity to send letters voicing our concerns to the Parole Board. In order for our voices to be considered we must ensure out letters contain accurate identifying information and the letters must be sent within 10 days. A conservative deadline of Tuesday June 20, 2006.
Please be sure your letters include this reference:
Offender: Solis, Santos III State ID: 07296364 TDCJ ID: 01334571 Placed in Parole Review on 6/6/06

As a reminder, Mr. Solis received a 10 year sentence on October 13, 2005 for two 2nd degree felony vehicular manslaughter by intoxication charges and one third degree felony vehicular assault by intoxication charge for the offense committed on 12/18/04.

Through improper handling of paperwork and good legal representation, Mr. Solis was able to keep Ector County from knowing about this pending charge and delay sentencing until after the manslaughter case. This prevented any consideration of the Maverick County case as a prior felony offense on the sentencing in the Ector County manslaughter cases.

Here is my letter. Tell me what you think...
My name is Heidi and I am James Cucovatz’s aunt. I would like to take a moment and share with you my personal experiences with James with the hope that you will see why the man that (in my view) murdered him, Santos Solis III State: 07296364 and TDCJ 01334571, must not be released until his (in my view extremely light) sentence has been served.
James was respectful and selfless. In fact, the last time my husband and I got the chance to speak with him was the day our son was born. December 15, 2004 James had called to tell us congratulations! This may seem like no big deal to you, but at the time, James was 18 years old and he was getting ready to go to Mexico with his girlfriend so the simple fact that he was thinking of us during that time speaks volumes to his character and nature.
James cared about his family, especially his mother. The first thing he said when I told him I was pregnant was, “my mom loves babies, and I am so excited for her!” As long as I live, I will never forget his words “I am so excited FOR HER.” He was so unique in that way.
James was willing to spend time doing things for others. When my husband and I were thinking about moving to Dallas, he spent three days driving us through different neighborhoods looking at houses. He never once complained- he only laughed and told us about school, his racing, and many friends.
James had a promising future. He had been a racer on the motocross circuit for I do not even know how long and had started announcing races. He became more and more popular as time went by and still to this day if you put his name in your Google bar several sites will come up.
I could continue in this way for days. I think that you get the point, however. What message will the state of Texas be sending if Mr. Solis walks free in such a short time? If you ask me I would say that the message I hear is that the state of Texas is not concerned about the family that Mr. Solis hurt or others he may hurt in the future.
I would like the state of Texas to tell Mr. Solis, that he must pay the consequences for his actions. That he is not allowed to recklessly take my sweet nephew and intrude into my family’s life in such a horrifying way, the week we were supposed to be celebrating the birth of our newest member, my son, Mason.
Please, do not send the message that driving drunk is an appropriate behavior. Please make him understand that James was a human being with a family who loves him and misses him every moment of every single day. Mr. Solis needs more time to think about those he has hurt.
I beg you to consider my son, James’ cousin. Consider the fact that my son has been robbed of the opportunity to meet someone who was excited about his entry into this world. James could have been an example for my son to follow. He could have been my child’s friend and confidant. My son will only ever hear stories; will only know James through pictures and words.
Please, force Mr. Solis to think some more. He is not ready to rejoin society and most importantly, we are not ready to rejoin him.

It's a well written "personal" letter that should make an impression on the parole board.
You might also want to get ahold of MADD (Mothers Against Drunk Drivers) and make them aware of his upcoming hearing. They have alot of power.
I believe Bette Burns is the Director.

I just want everyone to know that James' mother is also very grateful for your support.
