This fat bastard is finally gone. What CNN doesn't say here is rupe killed 2 bank tellers and went into death row at 250 LBS then he balloons up to 410 pounds by eatin' tater chips and junk food. which the prison system allowed him to do. Then he goes to a stupid federal judge saying he's too fat to hand, cause he will decapitate. and Federal Judge John Coughenour of Seattle rules he's too fat to hang, and throws out the death sentence and sends it back to court for resentencing, then one lone juror votes to give him LWOP. So they take him off death row. He asks the state for a liver transplant, and they deny him. I've posted about him before and what Sheriff Hege said about him LOL. Rupe shot two Olympia bank tellers to death at point-blank range during a 1981 robbery. Juries twice sentenced him to death, but higher courts overturned the sentences. In 1994, a federal judge upheld his conviction but agreed with Rupe's contention that at 400 pounds, he was too heavy to hang because of the risk of decapitation. Rupe argued that would be cruel and unusual punishment. At the time, Washington's only manner of execution was hanging. The main method now is lethal injection. Prosecutors tried for the death penalty a third time in 2000, but a jury deadlocked 11-1 -- just shy of the unanimous vote required for capital punishment. Rupe suffered from a terminal liver disease, and there was doubt at that time whether he would have lived long enough to be executed even if the jury had been unanimous NOTE: CNN gets it wrong when hanging was the only method at the time. It was the primary method of execution at the time, LI was a 2nd choice. Now it's reversed.

If he was too fat to hang, they should have put him on a STRICT diet the year before his execution to 'get him ready'.

Why didn't Washington put him on a diet. The courts have ruled that the state can make an inmate take medicine that will keep him mentally OK so that he can be LI.

The worst part is that he actually had the audacity to ask for a liver that would otherwise go to a functional productive member of society. So he kills two people and wants to be indirectly responsible for the death of a third.
At least Washington had enough sense to indirectly execute him by denying his request

Chazz Provision of a diet adequate to maintain his admission weight of 250 lbs. is hardly cruel and unusual. Addtionally, the 14th Amendment, to my knowledge, does not provide a provision requiring the state to finance his morbid obesity.

The scumbag became overweight so that he could avoid the death penalty but if his being overweight was the reason he was denied then the irony is delicious. Figuratively speaking of course.

I actually agree with the judge.
If Rupe was sentenced to die by hanging, then he should die by hanging.
Rupe should have been resentenced to death, but this time by decapitation from hanging.

Rupe should have been resentenced to death, but this time by decapitation from hanging. correct me if i am wrong, i was under the assumption that the convict had the choice with LI being the default means of execution
