The great American "jurisprudence" and their every-idiot-on-a-jury-system destroyed this man's life. Actually, funny little Nazi, Richey was not tried by a jury. He didn't want a jury trial. He asked for, and received, a bench trial. Has your "sharp intellect" left you recently? I was complaining about your "jurisprudence" and it's procedures. What do you think why Kenny did not want a jury trial? As for the Nazi - I just wanted to visit some Native Americans, but I had to learn that there's no one left. Where have they gone? I mean, they were millions before you established your great nation ........

Why would Richey want a new trial, this time by jury, if he thought so little of American juries? I hope there is a new trial, either to clear him or prove once and for all that he did what he did -- kill an innocent human being.

Shall we all sing the song Kenny likes to sing One Two Three Altogether now: "Im coming home ive done my time............... Thanks Hazel! I really appreciate your postings concerning Kenny Richey. Kenny is innocent, there's no "new evidence" and they just try to prolong his stay on death row. It's a defeat for them, a terrible defeat! All those self-righteous prosecuters who don't give a *f---* about a man's life if they can do something that's good for their career. I have just made a subsription for his brother's book and I hope they will deliver it fast, even to non-english speaking countries. 18 yrs in Yankee prisons are enough - Come home Kenny! Euro. Of course Kenny is INNOCENT. I know it and thousands of others know Kenny is innocent. Come early September Kenny will be a free man. As ive said before im proud to be scottish and im proud that we have such a brave man like Kenny who is also scottish. I cant see no point in retrying Kenny again there aint no new stuff that will re sentance him to death again. Kenny was a free man the day they quashed his murder sentance and should have been set free then

Of course Kenny is INNOCENT. I know it and thousands of others know Kenny is innocent. Come early September Kenny will be a free man. KNOW he's innocent? You assume he's innocent! RICHEY KNOWS if he's innocent or guilty, and if he's guilty he's still going to do everything possible to save his horrible skin! You may be proud of yourself being Scottish, but I certainly wouldn't be proud of a guy like Richey being ENGLISH! Richey had a criminal record a mile long and even boasted about his evilness! His brother doesn't appear to be much better, himself being convicted of murder but he took the easy way out on a plea bargain to escape a possible death sentence! Whta a pleasant family! Yeah you sure have every reason to feel proud of such scum! Dozens of appeals which confirmed his guilt, then along comes one court who fails to see it. What's wrong with allowing the state to seek a another opinion, after all the many other courts might just be right over that single one!

The prosecution has had lots of time to prepare its case against Richey, if they still want to prosecute him, and they will take into account every possible grounds for appeal. As I recall, the higher courts have not declared Richey innocent, otherwise Richey would not be in jail. It will be funny indeed if he's retried and convicted and sent back to death row.

KENNY is SCOTTISH theres a big difference between english and scottish. And theres a big difference between Kenny and Tom is Tom has always admitted to his crime. Tom shot a shop assistant dead years ago and was sentanced in washington. He knows what he did and has said he is guilty. NOT ONCE has KENNY said he was guilty and that he started that fire which killed the little girl.
Call them scum call them whatever you like hunny if it makes you feel better fire away

I know that, because I'm ENGLISH - You can have him, and as I said I wouldn't be proud of him if he was English! There are at least some murderers who admit their guilt, not all but some! When Richey is on his deathbed, I wonder if he will ask God for forgiveness and admit to his crime and to all his lies! It might be his last chance! What will I do? The same I will do if he is found guilty a second time - nothing!

Kenny has stood by for 18 years and said he never ever started that fire. He could and would have been free years ago now if he accepted a plea bargin he was given and he never took it as it meant he would still be guilty.
I tell you one thing if i was guilty and they gave me the same plea bargin they gave Kenny i would have jumped at the chance. But he never as he WILL not admitt to something he never done.
Now that shows me what a strong proud and brave man KENNY RICHEY really is.

One recent example was, Donald Jones in Missouri. he murdered his own grandmother when she refused to give him money for drugs. He didn't think he would get the death penalty so he refused the plea, if he had accepted the plea he would have gotten lwop.

In the US a person is not found "innocent" they are found "not guilty" which means there wasn't enough evidence to convict someone. In Richey's case the court in no way shape or form declared him "innocent" they ruled that the evidence at the time did not support a Capital Murder charge under the laws in place at the time that is a big leap to saying he is innocent.

I will try to say this again, the court that ruled on this case, looked at the law as it applied to the Capital Murder charge. The court said he the charge should have been a lesser charge. That is the reason they overturned the sentence, he must be retried on a lesser charge has nothing to do with them finding him innocent or guilty.

The ones not proven guilty are left to prove their innocence in the court of public opinion. This is as it should be.

No what I am saying is there is a difference in the meaning of the words innocent and not guilty, OJ was guilty as sin, he was found not guilty (beyond a reasonable doubt) he wasn't found innocent. Under the laws of the US the accused once found not guilty can never be re tried.
AS to your insinuation about our legal system, I wouldn't throw any stones if I were you considering the way your legal system lets murderers out of jail. I don't have a problem with the US legal system it seems tha the only ones who don't like it are the crimminals and their supporters.

Putnam County cell sought for Richey Lawyer wants client moved off death row
As the decision whether to retry Kenny Richey is to be announced tomorrow in Putnam County, his attorney filed a motion yesterday in federal court to have Richey moved to the Putnam County jail.
The motion by Ken Parsigian of Goodwin Procter in Boston, filed in Cleveland's U.S. District Court, was the latest salvo in a sparring match between the Richey camp and the state since the overturning of Richey's arson conviction in January was affirmed June 3.
"It's a lot of posturing; it's much to do about nothing," said Jim Canepa, chief deputy of the attorney general's criminal division. "At the end of the day, it doesn't matter where [Richey] is as long as he's incarcerated."
But Mr. Parsigian, in his motion, argued that once Richey's conviction was overturned and the state was given 90 days to retry or release him, he no longer qualified as a death-row prisoner and should be moved to Putnam County. "Even if you could bring a new charge for murder, it would be just that - a charge - and could not serve as a basis for keeping him on death row," Mr. Parsigian wrote in a letter to Mr. Canepa's office yesterday.
Mr. Canepa said the situation will become clearer tomorrow when Putnam County Prosecutor Gary Lammers will announce his decision whether to retry the 41-year-old Richey for the 1986 arson death of 2-year-old Cynthia Collins of Columbus Grove, Ohio.
Tomorrow is the 19th anniversary of Cynthia's death in an apartment fire Putnam County prosecutors said Richey set in attempt to kill his former girlfriend and her lover, who lived below Cynthia and her mother, Hope Collins.
Over the years, Richey's attorneys and reporters have uncovered numerous questionable issues in the case. The U.S. 6th Circuit Court of Appeals' deci-sion to overturn his conviction, however, was based on a violation of his constitutional rights.
Mr. Lammers declined to be interviewed yesterday. A spokesman said Mr. Lammers would release a written statement tomorrow afternoon.
Richey, whose mother is Scottish, spent his first 18 years in Scotland, and the case has been widely publicized in Britain for years. Prime Minister Tony Blair has been involved as has the Vatican. Amnesty International has called it one of its most important death penalty cases.
In an interview last week, Mr. Lammers, who became prosecutor in January, said he would ignore the fuss.
"It's pretty amazing that it has as far-reaching [impact] that it apparently has, but I'm not going to get mixed up in that. I'm going to interview witnesses and look at the scientific evidence to make my best call in this case, whether it's an international story or petty theft. All cases are important to those who they affect," he said.
Mr. Canepa said he believes Mr. Lammers is properly handling the announcement.
"I think it makes a lot of sense," he said. "If he decides not to retry him, he'll include those decisions in his release. If he decides to retry him, it's not fair to talk about it. He'll be in a trial strategy [mode] at that point."
Should Mr. Lammers opt for retrial, Mr. Canepa said it would pave the way for moving Richey to the county jail.
Two issues then emerge.
"Which court sets bail, and can Richey make bail," Mr. Canepa said.
Mr. Parsigian and the state also have been sparring over the 90-day deadline, which expires Sept. 1. He said the state has to begin the trial by then or seek a federally mandated extension. The state has said it only needs to begin the trial process.
"If there's a dispute, it will be resolved by the courts," Kim Norris, a spokesman for the attorney general's office, said last week.
Should Mr. Lammers pass on returning Richey to court, he could sign documents that would lead to Richey's release in about a week, according to Andrea Dean, an Ohio Department of Rehabilitation and Correction spokesman.
"Once we receive the paperwork, we would start the process," Ms. Dean said.
Typically, according to Ms. Dean, it takes two to four working days to receive the paperwork and 24 hours for the prison system to complete its process before releasing an inmate.

ive just read they will announce his decision late tomorrow afternoon.

Today is D-Day for Kenny when we all find out what Mr Lammers decision is on Kenny's case. But also on this date back 19 years ago Cynthia Collins lost her life (30th June 1986) Today i will hope for the best possible outcome for Kenny, Karen and his family and friends. And today i will also say a prayer for little Cynthia
