Supreme Court refuses to review Mendoza's capital murder case (Created: Tuesday, June 2, 2009 8:48 PM CDT) By Danny Gallagher, McKinney Courier-Gazette An inmate from Collin County sitting on Texas Death Row for murdering a Farmersville mother has exhausted all of his appeal options and awaits his execution date. The U.S. Supreme Court declined to hear the appeal of 25-year-old Moises Sandoval Mendoza's capital murder conviction as one of the 157 cases petitioned to the federal court on Monday, according to an order list compiled by the federal court. Monday's decision not to examine Mendoza's appeal represents the last legal option for the Death Row inmate in the state and federal court system. The case will now be sent back down to 401st District Court Judge Mark Rusch who will set Mendoza's execution date, according to the Texas Department of Criminal Justice. It is not, however, Mendoza's last option to avoiding the lethal injection chamber. Mendoza can ask Texas Gov. Rick Perry or the Texas Board of Pardons and Paroles to grant him clemency in the shadow of his execution date, according to the Jamail Center for Legal Research at the University of Texas School of Law in Austin. Mendoza was found guilty of the capital murder of Rachelle O'Neil Tolleson, 20, of Farmersville, whom he strangled, raped and stabbed in March 2004. Mendoza then tried to dispose of the body by burning and dumping it in an eastern Collin County creek bed. A jury found Mendoza guilty of capital murder and sentenced him to death by lethal injection in June of 2005, according to Collin County court records. Mendoza became the 12th defendant sentenced to the death penalty in Collin County since 1976,. He has been on Texas Death Row for just under four years, according to TDCJ. The 165-page appeal report filed in the Collin County District Clerk's Office listed a total of 81 issues with the state's case and the trial held in 401st District Court during the voir dire, trial and punishment phases. One of the issues states the evidence presented to the jury was “legally” and “factually insufficient” to support a guilty verdict of capital murder, according to the report. The report asks the higher courts to “reverse judgment of the trial court and remand for a new trial,” according to the report's prayer. Mendoza's appellate attorney, John Tatum of Dallas, could not be reached by presstime for comment. It could be faster, but then again, I'm not really complaining that much. Is he a foreign national? Are they gonna pull some crap like they did with Chi?

No, he's not a foreign national. I think the evidence against him was so strong that any appeals process would have to have a very strong argument to the courts. His victim was Rachelle O'neil Tolleson, a good friend of mine's daughter. The things that were done to her were unbelievable. I can't wait for a trip to Huntsville for the execution. The only shame is that he will die without suffering. Too bad we couldn't burn him like he did Rachelle so that he can't have an open casket like at Rachelle's. Her mother never got to see her, obviously closed casket. I'm sure he will be treated much better. He has lots of pen pals and a myspace page. Let's also not forget that he cut off his "ankle bracelet" and had 3 felony warrants against him. During this time he also raped two teenagers as well. I don't know why the police couldn't find him to pick him up for cutting off his ankle monitor or the 3 outstanding arrests warrants for him. One that was issued in October. She was murdered in March. Guess where he was the whole time? I know, it was really hard to track him down............he was at his house. This case is so screwed up I could ramble on for days.

I wonder which is correct, the article from KHOU or this one (you have to scroll down about 8 or 9 paragraphs): "Maria Mendoza, Moises's 57-year-old mother, said she got married in Mexico and moved to the United States in 1970. Their first son, Mario, was born in Mexico. Mario was left behind as his parents attempted to become legal citizens. If this story is accurate all capital cases should go through legal channels this quick. Perhaps the appeal process would be faster for all capital cases with the passage of the Streamlined Procedures Act. Instead of allowing courts to cuddle convicted murderers, we would be putting a few more of them in the ground where they belong. We need some hard pro judges in the appeals courts that will not side with the murderer & not allow frivoulous appeals or motions that will drag cases out.

Only in texas can you say your pro life and pro death penalty. . I am & do not see it as a mixed meassage. Nothing in life is absolute. Pro life means saving as many " innocent lives" as possible. Does not mean no abortions. Pro DP" if you take innocent life" by kidnapping, rape, murder, & burn the body means you hit the qualifications of the DP status. Many murderers do get LWOP or get lesser sentencing does not mean no DP as an option. Your Uncle hit the max not the state of TX. If that was my Uncle, I would ask why how could you have done this to this women? Not blaming everyone else, by calling others names is backwards. There's a reason the appeal process is there in the first place. America needs judges(and D.A.'s) who realise that the execution of one innocent person is always worse than 10 murderers going free - the last thing we need are nutcases who believes premeditated murder/executions are the solution to everything.
